Photography Services Agreement
This agreement constitutes an order for photography services between the Client and Jato Create (Joshua Choate).
Extenuating Circumstances
If the photographer, Joshua Choate, cannot perform this agreement in whole or in part due to an emergency, casualty, injury, acts of God, or any other cause beyond the control of Joshua Choate, no liability will be held to Jato Create or Joshua Choate. This limitation on liability shall also apply if photographic materials are damaged in processing, lost through camera malfunction, lost in mail, or otherwise lost or damaged with fault on the part of the photographer.
In the event of an extenuating circumstance on Jato Create’s part, Jato Create will find and recommend an alternative photographer and reimburse the full amount paid to the customer, including the any down payment fees. Jato Create will not be held liable for services not rendered.
Photo Delivery
Jato Create will choose and deliver the best images taken. Jato Create does not show un-edited images, nor involve the clients in the process of choosing which images will be chosen for the final gallery. Jato Create spends a great deal of time reviewing each image individually. Please rest assured that any images that are unappealing such as; closed eyes, unflattering facial expressions and most definitely, any images that do not meet Jato Create’s high professional standards, will get deleted immediately.
The images will be displayed in an online gallery on Google Drive within 6-8 weeks of the photos being taken. The online gallery will be available for a minimum of 8 weeks. This online gallery will be high quality but not be the full, original quality images.
The full, original quality images will be delivered to the client via USB flash drive. If you wish to order prints, it is highly recommended the flash drive images are used.
Copyright
Unless otherwise specified, it is understood that all copyrights to photos are owned by Jato Create and may be used for advertising, marketing, display, or any other purpose deemed necessary by Jato Create.
Prints
The Client has the right to print and use all delivered images from Jato Create at their discretion.
If you wish to order prints, Jato Create has an account with Miller’s Professional Imaging (https://www.millerslab.com/) and can place orders through this professional service. Contact Jato Create for order pricing. Payment to Jato Create is due prior to order placement with Miller’s Professional Imaging.
Social Media
It is encouraged that you share your photos taken by Jato Create on Social Media! When doing so, please tag Jato Create’s social media channels.
Cost
The total cost for the photography services will be agreed upon before the photos are taken. Final payment is expected upon completion of taking the photos. The Photographer will not deliver any photos until full payment has been received. Payments may be made by cash, money order, or personal check made payable to “Joshua Choate”.
